Environmental Soil Management Inc. (ESMI/Clean Earth/Enviri)

ESMI is a soil incinerator located on 304 Towpath Road, Fort Edward, NY.   Their original air and solid waste permits allowed them to process soils contaminated with petroleum, but have expanded to PCB's, Sewage Sludge, Paper Sludge, and even a test in 2018 on PFAs destruction (see current air permit). 

The village of Fort Edward learned of ESMI's Research, Development and Demonstration permit application to process soils contaminated with PFAS.  The application states that they facility can remove 99.9-99.99% of PFAS from soils, however, these claims are based on their own 2018 study.  The models of air emissions use the same 2018 PFAs concentration which were relatively low compared to the research papers they are using to support their claims.

Due to ESMI's proximity to Hudson Falls, a Disadvantaged Community and Environmental Justice Community of Concern, the DEC required that a Public Participation Plan be developed and that residents of Hudson Falls be notified of the application to burn PFAs.  DEC/ESMI communications show that ESMI was adamant that they were not required to take Hudson Falls into consideration. They even limited their emission modeling to 1.5 miles, just short of the DAC/EJ zones, when the model is capable of capturing data up to 3.1 miles aware from the emission point.  Just as emission concentrations were increasing, the model cuts off, leaving Hudson Falls without the information they need to understand how this facility will impact them.
